Welcome to the Chair Müller-Chen

With his dedicated team, the chair Müller-Chen offers various law courses on the bachelor, master and doctorate level. Furthermore, term papers are supervised at all levels.

Prof. Dr. Müller-Chen is professor for private law, (international) private and commercial law as well as comparative law at the University of St.Gallen. Besides that, he teaches in various executive education seminars.

The academic career of Professor Müller-Chen has always been influenced by international themes. He was a visiting scholar at Boalt Hall School of Law (UC Berkeley) and a visiting professor at Santa Clara University in California. Since 2010 he has been Delegate for Internationalization of the Law School.

Since 2009, Prof. Müller-Chen has been an independent lawyer in the areas of art law, contract law and arbitration. Prior to 2009 he worked in a law firm.

Professor Müller-Chen conducts research in the fields of comparative law, international commercial law, tort law, contract law and art law. In 2000 he received the city of Basel`s Science Award.

Historic success for our HSG Vis Moot Team!

The HSG Vis Moot Team wins the 32nd Willem C. Vis International Commercial Arbitration Moot. This is the first time in the 32-year history of the competition that a Swiss team wins the team orals against 383 competing universities.
 
Almost nine months of research, writing, pleadings in Swiss law firms, and preliminary rounds in Riga, Berlin, Munich, and Belgrade culminated last week in Vienna. The team, consisting of William Frauenfelder, Kara Ölke, Dominic Rode, Alexander Stadelmann, Sofia Truniger, and Raphael Wüthrich, competed in four qualifying rounds in Vienna, in which all six team members pleaded. Through their excellent performances, they qualified for the final rounds among the best 64 universities.
There, the HSG Vis Moot Team prevailed against five strong opponents. On Thursday, Dominic Rode and Alexander Stadelmann faced the McGill University from Canada in an exciting final hearing at the Austria Center in front of over 3,000 spectators, where they convinced the experienced tribunal with their arguments.
 
In addition to winning the Eric E. Bergsten Award for winning the oral phase, the HSG team received further awards: both written submissions were awarded an Honourable Mention. On top of that, Sofia Truniger and Alexander Stadelmann received Honourable Mentions for their outstanding rhetorical skills.
  
The HSG Vis Moot Team was coached by Prof. Markus Müller-Chen, Prof. Marco Stacher, Jurij Santschi, Nadine Boss and Cédric Schad. 

Multiple achievements by the University of St. Gallen at the Willem C. Vis Moot in Vienna, April 2022

The Willem C. Vis International Commercial Arbitration Moot Court is an international legal competition where a fictional commercial dispute is simulated before an arbitral tribunal. In this year’s rendition, 365 teams from across the world took part. After a number of successful Pre-Moots throughout the spring, the team of the University of St. Gallen, as the only Swiss university, managed to once more proceed to the Round of Best 16. In addition, the team also secured an Honorable Mention for the Memorandum for Respondent while Damian Wyss (MLaw) was also recognized as among the best individual oralists. The team thereby continues a legacy of success at the Willem C. Vis Moot.

The Law School warmly congratulates the team on this great achievement.

2nd place for Swiss Moot Court

We are proud to announce that a team of the Law & Economics students Luzia Bremi, Danielle Hefti, Philipp Kessler und Raphael Wüthrich represented the University of St. Gallen at this year’s edition of the Swiss Moot Court and made 2nd place. At this year’s edition of the Swiss Moot Court, the participants had to solve a complex inheritance law case. With their written papers submitted in November, the team of the University of St. Gallen qualified for the oral round in mid-February, where the 12 best teams from all over Switzerland were allowed to plead against each other. Due to their their outstanding pleading performance in German and French they then succeeded to get into the finals, where they came in 2nd place. We congratulate the team for their great performance.

Courses

Code of Obligations: Discussion of general contract law in the general part of the Code of Obligations including its influences on the special part of the Code of Obligations as well as discussion of the specific types of contracts in the special part of the Code of Obligations. Application of this theoretical knowledge in various case studies. 

International private law: Introduction to the general part (method) and the special part (connection to different parts of private law) of international private law. Raising awareness for the specific issues and needs in international legal relations as well as linking international private law with international civil procedure law.

Willem C. Vis International Commercial Arbitration Moot: Participation of the students in the Willem C. Vis Commercial Arbitration Moot (worldwide competition with participation of more than 200 teams). Solving a case in the field of international arbitration and the Vienna Sales Convention (CISG) by writing memoranda and pleading the case in front of fictitious courts. 

Great Legal Traditions and Cultures of the World: Introduction and conveyance of knowledge about foreign judicial system (e.g. civil law, common law, religious law). In cooperation with the IDSC (Institut Suisse de droit comparé) in Lausanne the students are taught the methodic approach to write a term paper about a subject in comparative law.

Comparative Law as a Research Method: Introduction to foreign legal systems, in particular civil law and common law. Emphasis is placed on teaching the methodological approach for writing comparative law dissertations.

Research

The Chair Müller-Chen researches in the field of national and international private law, art law as well as comparative law with a practical perspective. The result of this research is a large number of publications in recent years. In addition, Prof. Müller-Chen is active in executive education.
