AI product liability: Should Switzerland follow the EU law?

Who is liable in the event of an accident involving a self-driving car or a medical misdiagnosis by AI? The spread of artificial intelligence poses new challenges for product and operator liability. While the EU introduced a new product liability directive at the end of 2024, it is not yet clear how Switzerland intends to regulate AI in the future, even after the Federal Council's most recent interpretive.

The topic of AI regulation in Switzerland is also the subject of the second AI conference organised by the Law & Tech Lab of the University of St.Gallen.
